Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ShotCanvas ("ShotCanvas," "we," "us," or "our") governing your access to and use of the ShotCanvas mobile application, web application, and related services (collectively, the "Service").

By downloading, installing, or using ShotCanvas, you affirm that you are at least 13 years of age (or 16 years of age if you are in the European Economic Area), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree to these Terms, do not use the Service.

If you are using ShotCanvas on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" shall include both you and the organization.

2. Description of Service

ShotCanvas is a screenshot design and marketing image creation tool that enables users to:

• Upload and manage app screenshots from mobile devices
• Apply professional design templates to create App Store and Google Play marketing images
• Use AI-powered features to generate design layouts, headlines, and color palettes
• Record screens on Android devices and extract frames for use as screenshots
• Export finished marketing images in formats required by Apple App Store and Google Play
• Sync drafts and projects across devices via cloud storage

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you.

3. Account Registration

To access certain features of ShotCanvas, you must create an account using Google Sign-In or another supported authentication provider. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your credentials and not share your account with others
• Notify us immediately at support@shotcanvas.app if you suspect unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or in violation of these Terms.

4. Subscription Plans and Billing

4.1 Free Tier

ShotCanvas offers a free tier that includes limited exports per calendar month, a limited number of saved drafts, and access to a subset of design templates. Free tier limits may change from time to time, and we will provide reasonable notice before reducing limits for existing users.

4.2 Pro Tier (Coming Soon)

A Pro subscription plan is in development and will be made available in a future release. The Pro tier will provide unlimited exports, unlimited drafts, access to all templates, AI-powered design features, background image support, and other premium capabilities. Pricing, billing terms, and cancellation policies for the Pro tier will be disclosed prior to launch.

4.3 Refund Policy

All paid subscription purchases are final unless otherwise required by applicable law. If you believe you have been charged in error, contact us at support@shotcanvas.app within 30 days of the charge, and we will review your request on a case-by-case basis.

4.4 Changes to Pricing

We reserve the right to change our pricing at any time. For paid subscribers, any price changes will take effect at the next renewal date after at least 30 days' prior notice.

5. User Content

5.1 Ownership

You retain all intellectual property rights in the screenshots, images, text, and other content you upload or create using ShotCanvas ("User Content"). These Terms do not transfer any ownership of your User Content to us.

5.2 License to ShotCanvas

By uploading User Content to ShotCanvas, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, and transmit your User Content solely to the extent necessary to provide the Service to you. This license terminates when you delete your content or close your account, subject to reasonable technical and operational delays.

5.3 Responsibility for Content

You represent and warrant that:

• You own or have the necessary rights to the User Content you upload
• Your User Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party
• Your User Content does not contain viruses, malware, or other harmful code
• Your use of the Service to process User Content complies with all applicable laws and regulations

5.4 Prohibited Content

You may not upload or process content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Infringes any third party's intellectual property or other rights
• Contains malware, spyware, or other malicious code
• Violates the privacy of any person without their consent
• Depicts minors in any inappropriate or exploitative manner

6. AI Features and Third-Party Services

ShotCanvas uses Google Gemini AI to provide certain automated design, headline generation, color extraction, and frame selection features. By using these AI-powered features, you:

• Acknowledge that your screenshots and design inputs may be processed by Google's AI systems in accordance with Google's applicable terms of service and privacy policies
• Understand that AI-generated outputs (headlines, layouts, suggestions) are automated and may not always be accurate, appropriate, or suitable for your specific use case
• Accept responsibility for reviewing, editing, and approving any AI-generated content before use
• Agree not to use AI features to generate content that violates these Terms or any applicable law

We are not responsible for the accuracy, appropriateness, or suitability of AI-generated outputs. You should always review AI-generated content before publishing it.

7. Acceptable Use

You agree to use ShotCanvas only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to create misleading, deceptive, or fraudulent app store listings that violate Apple App Store, Google Play, or other platform policies
• Attempt to circumvent subscription limits or access features not included in your plan
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated means (bots, scrapers, scripts) to access or use the Service in ways not intended or authorized
• Resell, sublicense, or commercialize the Service or its outputs without our prior written consent
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
• Attempt to gain unauthorized access to any portion of the Service or its related systems
• Use the Service to develop a competing product or service

8. Intellectual Property

8.1 ShotCanvas Property

The Service, including all software, design templates, algorithms, brand elements, documentation, and other materials (excluding User Content), is owned by ShotCanvas and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

8.2 Design Template Outputs

Exported images generated using ShotCanvas templates are owned by you, subject to (a) your ownership of the underlying User Content, and (b) any restrictions imposed by third-party fonts, icons, or graphical elements that are licensed separately. It is your responsibility to ensure that any third-party assets you incorporate comply with their respective licenses.

8.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use that Feedback in any manner, without any obligation or compensation to you.

9. Privacy

Your use of ShotCanvas is also governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

10. Disclaimers and Limitation of Liability

10.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

10.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHOTCANVAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD IF YOU HAVE NOT MADE ANY PAYMENTS.

10.3 Essential Basis of Bargain

You acknowledge that these limitations reflect a reasonable allocation of risk, and that ShotCanvas would not provide the Service without these limitations.

11. Indemnification

You agree to indemnify, defend, and hold harmless ShotCanvas and its officers, directors, employees, agents, and licensors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third party's rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. If we terminate your account for breach of these Terms, any active paid subscription will not be refunded, except as required by applicable law.

You may terminate your account at any time by deleting it through the app settings or by contacting us at support@shotcanvas.app. Upon termination, your right to use the Service ceases immediately, and we may delete your User Content in accordance with our Privacy Policy and data retention practices.

Sections 5.1, 8, 10, 11, 12, and 14 shall survive any termination of these Terms.

13. Changes to Terms

We reserve the right to update these Terms at any time. When we make material changes, we will notify you via the app, by email, or by posting a notice on our website with at least 14 days' advance notice. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service.

14. General Provisions

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes not resolved informally shall be subject to binding arbitration, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

14.2 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and ShotCanvas regarding the Service and supersede any prior agreements.

14.3 Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.

14.4 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.5 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
